POSTPONEMENT OF UK COMPETITION COMMISSION’S TIMELINE

UK Competition Commission postpones the jurisdiction of the Eurotunnel's ferry activities between France and the UK until mid-March 2014

The announcement of the UK Competition Commission’s provisional findings concerning its jurisdiction regarding Eurotunnel’s ferry activities between Dover and France is postponed to mid-March 2014 from previously late February. The target date for a decision is postponed to early May 2014 from previously end April.

Background on decision by UK competition authorities On 29 October 2012, the UK Office of Fair Trading handed over to CC its inquiry into Eurotunnel’s purchase of certain assets from SeaFrance.

On 6 June 2013, CC issued a ruling requiring Eurotunnel to cease ferry operations at the Port of Dover. Following the ruling, Eurotunnel and SCOP appealed to the Competition Appeal Tribunal.

On 4 December 2013, CAT decided that CC had to further consider whether the transaction was a transfer of assets or a business which determines whether or not CC has jurisdiction to consider the transaction. CC was therefore asked to reconsider this point and issue a new decision.
